Industries

Consumer Products & Toys

The only sector here where the end user is routinely a child, and the only one where a certificate naming a superseded standard is itself the violation.

CPSC · United States EU · GPSR ISO · International

The Shape of It

The distance between a compliant design and a compliant shipment is the offshore inspection system: who tests, against what sampling plan, with what authority to stop a container. Most recalls in this sector are failures of that system rather than of the design.

The EU's General Product Safety Regulation, applying since December 2024, now asks non-toy consumer products for a documented risk file of their own — a discipline device manufacturers already run, arriving in an industry that mostly has not.

What Applies

8 Documents an Auditor Is Likely to Open

The working set, not an exhaustive register. Each row prints the body that issues it, so nothing here depends on the color of the rule beside it. Customer-specific requirements sit on top of all of it and are frequently where the real work is.

CPSC · US ASTM F963-23

US Toy Safety Standard. Mandatory under the CPSC since April 20, 2024; certificates issued on or after that date must cite this edition. Since March 12, 2026, 16 CFR 1250 also adds water bead requirements on top of it.

CPSC · US CPSIA

Consumer Product Safety Improvement Act. Third-party testing, Children's Product Certificates, and permanent tracking labels.

CPSC · US 16 CFR 1107

Testing and Certification. Periodic testing, material change testing, and the written plan behind both. Since July 8, 2026, certificate data is also eFiled with CBP at import (16 CFR 1110).

CPSC · US 16 CFR 1303

Lead in Paint. The oldest of these limits and still among the most frequently breached.

EU · GPSR GPSR 2023/988

General Product Safety. Internal risk analysis, technical documentation, and an EU responsible person. Applies since December 13, 2024.

Toy Safety. CE marking, a technical file, and the EU declaration of conformity. Replaced by Regulation (EU) 2025/2509 from August 1, 2030, which adds a digital product passport and bans PFAS and bisphenols in toys.

EU · Toys EN 71-1 / -2 / -3

Mechanical, Flammability, Migration. The three parts most often tested, and most often quoted incompletely. Cite the edition: the 2024 amendment to EN 71-3 has been harmonized since December 2025.

ISO · Intl ISO 8124

Safety of Toys. The international series, and the reference point for every harmonization argument.

In Practice

Three Things That Usually Go Wrong Here

Not statistics — QES's own reading of where these systems are most often found short, from thirty years of building and auditing them.

The Certificate Names a Superseded Edition

The product would pass the current standard. The Children's Product Certificate citing F963-17 is a compliance defect on its face, and a certificate is the first thing a recall investigation asks for.

Offshore Inspection Has No Documented Sampling Plan

“Inspected” then means whatever the inspector did that day, which is unreviewable and indefensible after the fact.

Nobody Defined What Counts as a Material Change

So a supplier substitution went through without retesting, and the certificate now covers a product that is not the product being shipped.

A Real-World Case

Lead Paint, Imported Toys, and a Record Penalty

Mattel’s 2007 lead paint recalls show what happens when the paint on a toy is not verified against the law it has to meet.

$2.3 millioncivil penalty, June 5, 2009, per CPSC
What Happened
In 2007, about 95 Mattel and Fisher-Price toy models were found to exceed the federal limit of 0.06 percent lead by weight in paint and surface coatings, a ban in place since 1978. CPSC says Mattel imported up to 900,000 non-compliant toys between September 2006 and August 2007, and Fisher-Price up to 1.1 million between July 2006 and August 2007.
What the Investigation Found
The toys were recalled between August and October 2007. CNN reported that Mattel’s 2007 recalls covered millions of Chinese-manufactured toys, for lead paint and for small-parts hazards. In settling, Mattel and Fisher-Price denied knowingly violating federal law.
What It Cost
Per CPSC, the $2.3 million penalty was the highest for violations involving the importation or distribution of a regulated product, and the third highest of any kind in its history.

Where to Start

Against the Clause, Not Against a Feeling

A fixed-price gap assessment — two days on your floor and in your files, from $4,200 — produces a clause-by-clause table: what you have, what the standard in your column actually requires, what is missing, and what has to be written — with an owner and a date against each line. You keep the findings whether or not you engage further.
